ECOWAS Court Verdict Exposes Weakness of Justice Torkonoo’s Claims – TOR Officer

The Corporate Affairs Officer of the Tema Oil Refinery (TOR), Godwin Mahama Ayaba, has described the dismissal of former Chief Justice Gertrude Araba Esaaba Torkonoo’s appeal at the ECOWAS Court as a significant endorsement of Ghana’s judicial processes.

Commenting on the outcome of the case at Kessben Maakye show in Accra, Ayaba said it was unfortunate that the former Chief Justice appeared to have lost confidence in the very judicial institution she once headed, leading her to seek redress at the ECOWAS Court over issues surrounding her removal from office.

According to him, Justice Torkonoo had accused the government on multiple counts and questioned the fairness, objectivity, and adherence to the rule of law within Ghana’s justice delivery system, particularly at the apex court.
He noted, however, that after what he described as a thorough scrutiny of the case, the ECOWAS Court concluded that the Government of Ghana had not treated her unfairly and that due process had been followed throughout the removal proceedings.
“The court systematically examined the matter and found no merit in the appeal,” he stated, adding that the dismissal of the case reinforces confidence in Ghana’s legal and constitutional procedures.
The ruling, he argued, should serve as a reminder that allegations against state institutions must be supported by evidence and that judicial processes should be respected.

The ECOWAS Court subsequently dismissed and rejected the appeal, bringing the legal challenge to a close.
