J.A. Plant Pool, Dr. Joseph Siaw Agyepong To Defend $2M Suit Filed By Attorney General Over DRIP Contract

J.A. Plant Pool (GH) Limited and its Executive Chairman, Dr. Joseph Siaw Agyepong, say they will “vigorously defend” a lawsuit filed by the Attorney-General seeking to recover US$2,000,000 allegedly owed under the District Road Improvement Programme contract.

In a statement released today, JAPP said the suit was publicized in the media before it was formally served on the company or its Executive Chairman. The company argues the early publication has caused “severe and unjustified reputational damage” to JAPP, the Jospong Group of Companies, and their local and international partners.

Company’s Position On The Contract
JAPP and Dr. Agyepong “categorically deny any indebtedness” to the Government of Ghana or its agencies related to the contract dated February 12, 2024, executed under DRIP.

Key points outlined by the company:
1. PPA Approval: The contract followed approval granted by the Public Procurement Authority on January 10, 2024, for government to procure equipment and machines from JAPP at a total cost of US$178,704,739.50.
2. Contract Sum: Both the PPA approval obtained by government and the subsequent contract stated US$178,704,739.50 as the cost.
3. Performance & Payment: JAPP says the contract has been “fully performed” with all machines and equipment supplied to the Government of Ghana. All payments required under the contract, it stated, have been made “in strict accordance with the terms of the contract.”

The company maintains it has fulfilled all obligations under the DRIP agreement and will defend the action in court.

DRIP was launched by government to improve road networks at the district level using locally procured equipment.

JAPP and Dr. Agyepong said they remain committed to supporting national development through the Jospong Group of Companies.
