J.A. Plant Pool, Dr. Joseph Siaw Agyepong Reject Attorney-General’s $2 Million Claim

J.A. Plant Pool (GH) Limited (JAPP) and its Executive Chairman, Dr. Joseph Siaw Agyepong, have strongly denied owing the Government of Ghana any money under the District Road Improvement Programme (DRIP), following a lawsuit filed by the Attorney-General seeking to recover an alleged debt of US$2 million.
In a statement issued on Tuesday, the company said it would “vigorously defend” the action in court and described the Attorney-General’s claim as unfounded.
JAPP expressed concern that details of the lawsuit had been widely circulated in the media before the company and Dr. Agyepong were formally served, arguing that the publicity had caused significant reputational harm to the company, the Jospong Group of Companies, and their business partners.
The company maintained that neither it nor Dr. Agyepong is indebted to the Government of Ghana or any of its agencies under the contract signed on February 12, 2024, for the supply of equipment and machinery under the DRIP initiative.
According to JAPP, the contract followed approval granted by the Public Procurement Authority (PPA) on January 10, 2024, authorizing the government to procure machinery and equipment from the company at a total cost of US$178.7 million.
The statement noted that both the PPA approval and the subsequent contract clearly stated the contract value as US$178,704,739.50.
JAPP further stated that the contract has been fully executed, with all equipment delivered to the government and all payments made in accordance with the agreed contractual terms.
“The contract has since been fully performed, with JA Plant Pool duly supplying all machines and equipment to the Government of Ghana,” the statement said, adding that all financial obligations under the agreement had been settled as stipulated.
