Ghana Bar Association’s Resolution on Chief Justice Suspension Lacks Legal Basis – Lawyer Raymond Bidema

Lawyer Raymond Bidema, a law lecturer at KAAF University, has criticized the Ghana Bar Association’s (GBA) resolution calling for the reversal of Chief Justice Gertrude Torkornoo’s suspension, stating that the resolution lacks legal grounding.
Speaking to Kessben TV on Maakye show, Lawyer Bidema questioned the legal foundation of the GBA’s resolution, asserting that it is not anchored in any constitutional provision. He emphasized that Ghana operates under a written constitution, and any action not grounded in it holds no binding effect.
“I don’t know on which law they anchored their resolution. The country is not a company where you can resolve by passing out a resolution to do a thing. I don’t think that whatever resolution the Ghana Bar has passed is binding on anyone because it is not anchored on any rule of law,” he stated.
Lawyer Bidema further argued that the GBA, comprising legal professionals, should be aware of the constitutional procedures involved in the suspension of a Chief Justice. He suggested that the association should allow the legal process to take its course without interference.
“Justice in this country is done by the court, and in this case, it’s about the constitution of Ghana. No authority or civil society has the power to do any justice except to go to court under Article 21 and Article 130 of the 1992 Constitution of Ghana,” he added.
He concluded by emphasizing that resolutions without a strong legal foundation have no consequential effect and that, as lawyers, ultimate support should be to the rule of law.
