The chief justice will not accept the petition submitted by the Special Prosecutor – Lawyer Effah Darteh
Private legal practitioner Lawyer Effah Darteh has stated that the Chief Justice will not accept the petition submitted by the Special Prosecutor.
The Office of the Special Prosecutor (OSP) petitioned Chief Justice, Gertrude Torkornoo, to remove Justice Edward Twum as the presiding judge on Madam Cecilia Dapaah’s case.
Speaking to lawyer Effah Darteh on Kessben FM’s Breaking News, said that the Chief Justice will not accept this petition because it is not based on solid fact.
According to him, in Ghana, the law allows to prove a presiding Judge’s potential bias in a case.
He noted that there is the need to have concrete evidence showing a relationship between the judge and the individual being prosecuted or clear evidence of bias for a petition to be considered.
He stressed that the Chief Justice will only accept the petition from the Special Prosecutor if it is based on real evidence rather than speculation.
