Lightwave obtains alternate service in libel action against Health Minister

Lightwave Health Care Solutions Limited has obtained a High Court order authorizing alternate service on Health Minister Kwabena Mintah Akandoh, amid an ongoing libel case.

The court approved the request after company counsel told the bench that multiple efforts to personally serve the Minister had failed.

Alternate service permits legal papers to be delivered via other methods when direct service proves impossible.

Under the court’s order, the Writ of Summons and Statement of Claim will be served by placing copies on the High Court General Jurisdiction Registry notice board in Accra, sending copies to the Clerk of Parliament for forwarding to the Minister, and posting the documents online to guarantee they reach his notice.
The firm is suing the Minister over remarks it claims were made during public forums, including media interviews, which it calls untrue and harmful to its standing.
In its statement of claim, the firm alleges the Minister charged it with inflating the count of healthcare facilities delivered, taking payment for unfinished work, and improperly securing roughly US$11 million.

It further points to statements where the Minister reportedly doubted the operability of the firm’s health information systems and hinted at potential fund mismanagement.

Per the company, the assertions have fostered a damaging public image of deceit and wrongdoing, undermining its trustworthiness domestically and internationally.

It is therefore urging the court to rule the remarks defamatory, compel a retraction and apology, and grant damages for the reputational and financial injury it claims to have endured.
