Some of the things the suspended Chief Justice Gertrude Araba Torkornoo are being put through are not necessary – Lawyer Ohene Gyan

Renowned legal practitioner, Lawyer Ohene Gyan, Esq., has weighed in on the ongoing disciplinary proceedings involving suspended Chief Justice Gertrude Araba Esaba Torkornoo, urging that her fundamental human rights be respected, even as due process takes its course.

Speaking on Kessben FM, Gyan acknowledged the legal and constitutional framework under which the Chief Justice has been suspended and is currently being investigated. However, he expressed concern over what he described as unnecessary treatment being meted out to her, despite it being technically part of the legal process.

Ohene Gyan ESQ emphasized that the legal system must never lose sight of natural justice, which goes beyond statutes and procedural law, and touches on dignity, fairness, and humanity. While he did not question the constitutional right to investigate a public officer, he stressed that the manner in which it is done matters just as much as the legality.

Justice Torkornoo, who was suspended earlier this month pending investigations by the appropriate authorities, has been the subject of intense public scrutiny. While details of the allegations remain limited in the public domain, the suspension has ignited heated national discourse on judicial independence, executive oversight, and now, human rights in legal processes.

Though the Judicial Council and the Presidency maintain that all actions taken are within the remit of the 1992 Constitution, Gyan’s remarks highlight the tension between legal formalism and moral obligation, a debate that is gaining traction as the proceedings unfold.
