Aggrieved Assembly Members In Ablekuma North Secure Injunction Against ‘Imposter MCE

Some aggrieved Assembly Members of the Ablekuma North Municipal Assembly, led by the Presiding Member of the Assembly, Hon. Ibrahim Sulley, have, through their lawyers, issued a writ against a gentleman by name, Kalamu Adamu Musha, who carries himself as the Municipal Chief Executive (MCE) of the Assembly even though he has not been lawfully confirmed as the MCE.
The writ, which is accompanied by an injunction application, seeks to prevent the said gentleman (the President’s Nominee), who happens to be the NDC’s Constituency Organizer for Ablekuma North, from holding himself as the MCE following his outright rejection by the Assembly Members during his confirmation on 13th May, 2025 at the Assembly’s conference hall.
Out of the 21 voting Members of the Assembly who participated in the confirmation exercise, Kalamu Adamu Mussah only managed to secure 10 votes representing 47.7% of the total votes thereby failing to meet the two-thirds majority threshold required by Article 243 of the 1992 Constitution and Section 20(1) of the Local Governance Act to be confirmed as MCE.
On account of the Nominee’s failure to get the approval of the Assembly Members per the results declared by the Electoral Commission, the Presiding Member, who, by law, is the convenor and chairman of the meeting, proceeded to adjourn the meeting indefinitely after a motion for adjournment was moved and seconded, following which a closing prayer was said by Hon. Grace Ennin, and Members dispersed from the Assembly Hall.
It, however, later emerged that in blatant disregard of the law and due process, a second round of confirmation exercise was purportedly organized by the Greater Accra Regional Minister, Hon. Linda Akweley Ocloo for NDC-sympathetic Assembly Members to acclaim the rejected MCE Nominee without notice to other voting Members of the Assembly. Per the provisions of the 1992 Constitution and the Local Governance Act, the Presiding Member of the Assembly is the ONLY person who can convene and preside over meetings of the Assembly.
It is against the backdrop of this clear illegality that the Presiding Member of the Assembly together with 7 other Members of the Assembly, proceeded to court to challenge the impugned second round of voting and to injunct Kalamu Adamu Musah from holding himself as the MCE for Ablekuma North
