Judges rely on common sense when no specific law exists – Dr. Justice Owusu Dapaa

Dr. Justice Owusu Dapaa has emphasized that common sense remains an important element in the application of the law, particularly in situations where there are no specific legal provisions to address certain issues.
Speaking on Kessben FM, Dr. Owusu Dapaa explained that the legal system recognizes the presumption that people act with ordinary common sense in many circumstances. He noted that where the law is silent on a particular matter, judges may rely on established legal principles and reasonable interpretation to arrive at fair decisions.
According to him, while statutes and legal precedents form the foundation of the justice system, common sense also plays a role in ensuring that the law is applied practically and fairly in appropriate cases.
