As long as it’s lawful, she can proceed and test the laws – Lawyer Otchere Benya on Torkornoo’s ECOWAS court action

Legal practitioner Otchere Benya has defended former Chief Justice Gertrude Torkornoo’s decision to seek redress at the ECOWAS Court, stating that she is fully entitled to test the legality of any process affecting her, provided her actions are within the framework of the law.
Lawyer Benya speaking on Kessben FM said every citizen has the right to challenge laws and procedures they believe may infringe on their rights.
“Once the process she is taking is within the laws, she can test the laws,” he stated, emphasizing that seeking judicial interpretation or review through the courts is a legitimate constitutional and legal avenue.
The lawyer noted that resorting to the ECOWAS Court should not be viewed as an attack on Ghana’s judicial system but rather as the exercise of a legal right available under regional and international legal frameworks.
