Kwabena Agyepong Raises Concerns Over OSP’s Handling of Ken Ofori-Atta Investigation

Former NPP General Secretary, Ing Kwabena Agyei Agyepong, has expressed concerns over the Office of the Special Prosecutor’s (OSP) investigation into Ken Ofori-Atta, questioning whether the OSP is conducting a public and media trial rather than following due process.

Ing Agyepong’s concerns stem from the fact that despite the OSP’s claims of having evidence, no charges have been brought against Ken Ofori-Atta, raising questions about the OSP’s readiness to prosecute. The OSP’s public declarations about Ken’s alleged wrongdoing can be seen as prejudicial, potentially undermining his right to a fair trial. Furthermore, the OSP’s actions may be perceived as overstepping his mandate, which is to investigate and prosecute, not to declare individuals fugitives or conduct media trials.

The OSP is investigating Ken Ofori-Atta over several issues, including contractual arrangements between Strategic Mobilisation Ghana Limited and the Ghana Revenue Authority, the termination of a contract between the Electricity Company of Ghana and Beijing Xiao Cheng Technology, procurement procedures and financial transactions related to the National Cathedral, a Ministry of Health contract with Service Ghana Auto Group Limited for purchasing and maintaining ambulances, and the handling and disbursement of funds from the Tax P-Fund Account of the GRA.

Ken Ofori-Atta’s lawyers have informed the OSP that he is abroad indefinitely for medical reasons and offered to represent him in his absence. However, the OSP has insisted on Ken’s physical presence, stating that a suspect in a criminal investigation cannot pick and choose how the investigative body conducts its investigations.

Ing Agyepong believes that Ken’s legal team should call the OSP’s bluff and challenge his actions. He emphasizes the importance of due process and the rule of law in Ghana, ensuring that investigations and prosecutions are conducted fairly and impartially.
