Petition Hits Land Valuation Division At Pantang For Acts Of Trespassing

A private legal practitioner James Mensah Kelley has been instructed by Mr George Muller to petition some individuals and institutions for trespassing on properties belonging to Mr George Muller and his grantees using red paint to mark the said properties and other properties in the Pantang area.

According to the plaintiffs comprising George Muller, Joseph Kwasi Okyere, Emmanuel Kotey Among, Victor Amani Dziwornu Fedah and Samuel Atta Gyarteng, they are appearing in the High Court of Adenta on 27th July 2021 on the claims that officials from the Land Valuation Division of the Land Commission have without any court order trespassed on their properties.

The petition noted that a grantee of Mr George Muller in 2012 by name of Alexander Kwaku Boadi took Pantang Hospital and Attorney General to court for a declaration of title to a parcel of land containing an approximate area of 0.38-acre recovery of the possession of the said land, damages for trespass and perpetual injunction.

PETITION AGAINST ACTS OF TRESPASS BEING COMMITTED BY LAND VALUATION DIVISION AT PANTANG, ACCRA

On behalf of Mr Nana Kwame Ofutu Quainoo, lawful Attorney for Mr George Muller, James Mensah Kelley a private legal practitioner has been instructed to petition individuals and institutions who matters on the above subject matter.

REASON

They are appearing in the High Court of Adenta on 27th July 2021. For the following reasons. According to the petition, Mr Nana Kwame Ofutu Quainoo who is an estate developer and currently working on the land claim officials from the Land Valuation Division of Land Commission had without any Court Order or judgement, trespassed unto the properties of George Muller a client and his grantees by using red paint to mark the said properties and other properties in the area, of photographs of the marking on the houses, are attached to the petition.

The petition indicated that somewhere in 2012, a grantee of George Muller by the name Alexander Kwaku Boadi took Pantang Hospital and Attorney General to court for a declaration of title to a parcel of land containing an approximate area of 0.38-acre recovery of the possession of the said land, damages for trespass and perpetual injunction. Which ALEXANDER KWAKU BOADI vs PANTANG HOSPITAL AND ATTORNEY GENERAL was the title of the suit and the suit number was FAL/258/2018.

Judgement went in favour of the plaintiff on 22nd February 2013. Copy of the said judgement is attached to the petition.

Regarding the fact that High Court judgement to effect that, Pantang Hospital Lands is different and distinct from George Muller and his grantees land, Pantang Hospital has resisted and opposed George Muller and his grantees from developing their land on an allegation that the said development posed a security threat to patients and workers.

Mr Nana Kwame Ofutu Quainoo who is the client of the developer, according to him enquired from the officials of Land Valuation Division as to why they marked the said houses and they confirmed instructions were given to them by the management of Pantang Psychiatric Hospital to value the buildings which they marked for the hospital to lobby the Government of Ghana to acquire the parcel of land around the Pantang Hospital for and on behalf of the Hospital.
