Former Attorney General, Ayikoi Otoo has stated that former Supreme Court Judge, Justice Kpegah’s use of “unpalatable” language in scandalizing the court could be an indication he has forgotten his legal training.
“To throw caution to the wind, become so emotional, forget your own training and begin to attack the credibility of the entire court system, saying it is for sale is very unfortunate… if you are dissatisfied with a ruling, you can go further and look into the matter but if you become so emotional that you use unpalatable language, scandalizing the whole court just because you lost one ruling, then I don’t think it is the best.”
Justice Kpegah in an earlier interview had cautioned the General Legal Council, the Judiciary and the Ghana Bar Association (GBA) to desist from conspiring to frustrate him in his case against the 2012 presidential candidate of the New Patriotic Party (NPP), Nana Addo Dankwa Akufo-Addo.
“They should not push me to the wall to make a number of damning revelations that will haunt them for the rest of their lives,” he had warned.
Mr Ayikoi Otoo, speaking on Eyewitness News, however maintained that no matter how much truth the comments of Justice Kpegah held, “if the language used amounts to scandalizing the court then the fact that you are even speaking the truth will not matter anymore and you will be held in contempt of court.”
“As a former Acting Chief Justice who handed over to Her Ladyship the Chief Justice, he could always use the system to correct whatever anomalies he has found but if he has a personal case he lost and has become peeved and as such scandalizes the court, then I think he’s fighting his own cause not anyone elses’,” he added.
