Parties Without Representation in Parliament (PWREP) On The Prosecution’s Case In Republic vrs. Kwabena Adu-Boahen & Others

The State has had every opportunity to make its case, yet the evidence presented by its own witnesses raises serious questions about the foundation of this prosecution. The truth is becoming increasingly difficult to ignore: the State has no case against Adu Boahene.
Justice cannot be built on suspicion, manufactured narratives or selective prosecution. The burden is on the State to prove its case, not on the accused to prove his innocence. When the evidence fails to establish the allegations, continued prosecution begins to look less like the pursuit of justice and more like persecution.
The State has failed to adduce sufficient evidence to establish a case capable of securing the conviction of Adu Boahene. The prosecution’s case, judged against the evidence on record and the testimony of its own witnesses, remains fundamentally weak.
The burden of proof rests squarely on the State. An accused person must not be subjected to prolonged prosecution where the evidence is insufficient to sustain the allegations.
More troubling are claims that judges of the Specialised Court have received brand-new Toyota Land Cruisers. These claims raise serious questions about judicial independence, institutional propriety and public confidence in the administration of justice. They deserve transparent clarification.
Justice must not only be done; it must be seen to be done. It must also be dispensed fairly, impartially and without favour or prejudice.
