CONFIRMED: Attorney-General’s Department to take over OSP cases – Deputy AG, Dr. Justice Srem Sai

Deputy Attorney-General and Minister for Justice, Dr. Justice Srem Sai, has announced that the Attorney-General’s Department will take over cases currently being prosecuted by the Office of the Special Prosecutor (OSP), in line with a High Court ruling.

The decision follows a legal challenge by an accused individual, Peter Archibald Hyde, who questioned the OSP’s authority to prosecute cases without prior approval from the Attorney-General. His lawyers argued that both the Constitution and the OSP Act require such authorization before any prosecution can proceed.

Court records show that the OSP was unable to prove it had obtained the necessary approval, prompting the High Court to direct that all such cases be handled by the Attorney-General until the matter is resolved.

Dr. Srem Sai stressed that his office will fully comply with the court’s decision, reaffirming its commitment to the rule of law and respect for judicial authority.

He added that steps will soon be taken to implement the ruling and ensure a smooth transfer of the affected cases.
