Legal expert Charles Owusu Juanah, Esq, and lawyer for the national cathedral project, has asserted that Justice Gertrude Torkonoo has no realistic path back to her former position.
“There’s no room for her return, no matter where she takes the matter,” he said. Instead, Juanah argued, the only meaningful legal debate now centers on whether she can still serve as a Supreme Court justice following her removal.
Juanah’s remarks reflect the complicated fallout from Torkonoo’s removal as Chief Justice, which was carried out in September 2025 following a report by a committee constituted under Article 146 of the 1992 Constitution.
He questioned the legitimacy of any attempt to reverse the decision, suggesting the procedural and normative weight now lies in defining her judicial status, not in reinstating her as head of the judiciary.
While the law does not explicitly bar a removed Chief Justice from remaining on the Supreme Court, Juanah maintains that, in practice, her return is unlikely. This sentiment aligns with other legal observers who point to tensions, reputational damage, and collegial challenges that could make a comeback unviable.
The issue remains deeply polarizing. Critics of her removal, including Torkonoo herself, have argued that due process was flouted.
