Wontumi’s Galamsey Case: The burden of proof lies on the Government and its Attorney – Lawyer Ohene Gyan

Renowned legal practitioner, Lawyer Ohene Gyan, has weighed in on the ongoing galamsey (illegal mining) case involving NPP’s Ashanti Regional Chairman, Bernard Antwi Boasiako, popularly known as Chairman Wontumi.
Speaking on Kessben FM’s Maakye morning show with Wofa Kofi Appiah, the lawyer emphasized that the burden of proof lies solely with the government and its attorney, not the accused.
According to Lawyer Gyan, while the allegations are serious, Chairman Wontumi, like any accused person under Ghanaian law, is presumed innocent until proven guilty. “It is not up to Wontumi to prove his innocence. The State, through the Attorney General, must present solid, credible evidence in court to establish guilt beyond a reasonable doubt,” he stated.
Wontumi has been linked to illegal mining activities through Akonta Mining Limited, a company reportedly involved in operations within protected forest reserves. He has consistently denied any wrongdoing, asserting that all his mining operations are legal and approved.
Lawyer Ohene Gyan cautioned against public trial by media and political commentary, stressing that only due legal process should determine guilt or innocence.
