Suit against UG over road tolls dismissed

The Supreme Court has dismissed a case brought by two students of the University of Ghana against the university over the decision by authorities to charge road tolls.

The court in its ruling Tuesday indicated that they had no jurisdiction to make any pronouncement as the issue of taxing was beyond their remit.

The two, Ernest Victor Apau and Musah Mustapha, who brought the action in their capacity as Ghanaians wanted the Supreme Court to stop the university from charging road tolls.

They wanted the highest court of the land to declare the action of the university unconstitutional.

They were also seeking the court to perpetually restrain the university and its agents from charging motorists who ply the university’s routes, citing a violation of Article 174 (1) of the 1992 Constitution which requires the approval of parliament before any sought of taxes are collected.
