Doctors strike: NLC must drag FWSC to court – Labour Expert

The National Labour Commission (NLC) has been advised to seek the intervention of the nation’s courts in order to compel the Fair Wages and Salaries Commission (FWSC) to implement the ruling it made concerning the grievances of medical doctors in 2011.

According to the Executive Coordinator of Labour Rights Institute, Mohammed Affum, “the labour law grants the Labour Commission that power to go to court to enforce its order… so if the Fair Wages Commission which represents government is not implementing the award, then the law requires the National Labour Commission to go to the High Court for an order to compel Fair Wages to implement the requirement of the award.”

Medical Doctors across the country have served notice they will resume their month-long suspended strike due to what they described as the delay and diversionary tactics being employed by the FWSC.

According to the Ghana Medical Association (GMA), the FWSC and government have failed to implement an award that was given by the NLC in November 2011 which was aimed at addressing the disparities in their salaries.

Mohammed Affum in an interview with Citi News opined that if the NLC did not take steps to resolve the matter through the court, “then nobody should blame the Medical Association to embark on an illegal strike.”

In a related development, the President of the GMA, Dr. Opoku Adusei has indicated that, “so far as the Labour Commission cannot go to court to enforce its laws,” they will withdraw their services when the need arises.
