The Supreme Court has dismissed the joinder application brought by 300 supporters of the governing National Democratic Congress (NDC).
The Court ruled that the applicants were not needed in the case.
The ruling followed preliminary arguments by lawyer for the applicants Komla Senanu who said his clients were citizens and interested parties in the case.
Citi News, Richard Mensah said moving the motion, Mr. Senanu said “the 300 applicants are a necessary party to the suit and for that matter they should be allowed to join; he also stated that they should be allowed to join because they are registered voters out of the 11,920 polling stations cited in this case, hence they have the right to be joined.”
However the Lawyer for the petitioners, challenging the validity of the 2012 presidential election, Philip Addison opposed the application of 300 people seeking to join the election filed by the presidential candidate of the New Patriotic Party, NPP, Nana Akufo Addo, his running-mate Dr. Mahamadu Bawumia and the National Chairman of the NPP, Jake Obetsebi Lamptey.
Philip Addison further argued the court will open the flood gates for needless joinder applications if it granted that of the applicants.
The judges of the Supreme Court agreed with his argument of the petitioners and dismissed the application.
The three petitioners are challenging the validity of the 2012 election results claiming they have evidence grounded in widespread irregularities in the elections, that President John Mahama was not elected according to law and the Electoral Commission was wrong in declaring him as the winner of the polls.
